This record separates an earlier chemical-fill removal from a renewed residential investigation. Proximity to Love Canal does not establish the source of newly encountered material.

1990–1991
Agency records identified pesticide-affected fill near Black Creek Drive and 100th Street. The 1991 decision described three lots and proposed removing approximately 900–1,000 cubic yards.
1993
July 2026 reporting describes a subsequent removal accepted by DEC on August 24, 1993, including part of 9903 Black Creek Drive.
July 2026
Daniel and Jocelyn McKiernan sought testing and relocation after pool excavation exposed unusual fill. DEC reported receiving the complaint July 15 and sampling fill and basement sump liquid July 22.

Documented impacts
- DEC’s response in the July 31 report identified graphite rods and other debris. Its surface radiological scan found no readings above background. That scan does not resolve chemical composition or subsurface conditions.

The site today
The residents’ reported odors and basement material warrant documentation as concerns, not proof of exposure or a Love Canal release. Chemical results were pending in the July 31 account.
A surface screening result does not answer every environmental question about the fill.
